While Zane Kilian's scheduled bail application in the Kinnear investigation this morning was botched AGAIN by Covid and the sudden announcement that additional charges have been laid against him, it appears as if the prominent footage of the actual killer and his helper in a getaway car has completely slipped the mind of the investigators?

The 39-year old former rugby player of Springs has been in custody since 21 September 2020 and appears to be the ONLY focus and (very unlikely) suspect in the shocking assassination of lt.col. Charl Kinnear on 18 September 2020 in broad daylight in front of his Bishop Lavis home.

Tired, 20 kg lighter and traumatized by the past 6 weeks' ordeal, Kilian was in better spirits yesterday afternoon and looking forward to this morning's long-awaited bail application in the Bellville magistrate's court .

No sooner had his attorney Eric Bryer and adv. Eckhardt Rösemann left him at the Bellville holding cells late yesterday afternoon after preparing for his court appearance, when police officers visited him again in an attempt to negotiate a plea bargain and/or persuade him to become a state witness. Kilian refused to address them in the absence of his attorney and Bryer had to be called back.

They were informed that the same National Prosecuting Authority (NPA) who earlier refused to investigate Kinnear's serious allegations of a rogue crime intel unit operating illegally in the Western Cape, are now planning to add several additional charges against Kilian - including conspiracy to kill Cape Town attorney William Booth and fraud for claiming to work as a private detective when he was allegedly not registered with the Private Security Industry Regulatory Authority (Prisa). Booth was allegedly involved in an attempted hit at his home in April this year.

In the light of the above and because the presiding magistrate had apparently been diagnosed with Covid-19, the application did not go ahead and was postponed till the earliest available date on 27 November 2020.

Furious and frustrated family members of Kilian are concerned about his health and mental state and the power games being played.
"The Police had almost six weeks to investigate this high-profile case and all they concentrated on till now is Zane's cellphone tracking records and 'qualifications'. Where is the real killer and the people who gave the orders? Why is nothing ever mentioned about the footage showing the shooter walking around in Bishop Lavis for six hours prior to the shooting without ever speaking on a cellphone? Why did they have to wait till the night before Zane's bail application to come forward with these additional charges?
"This was a devious ploy to arrest him immediately again if bail was granted!" a relative said.

Kilian's family and friends are convinced that he was set up as a convenient scapegoat and decoy to derail the investigation in order to protect the same rogue police officers and gangsters whose criminal activities Kinnear exposed in a lengthy 59-page Affidavit that the slain police officer compiled and sent to the highest authorities in 2019. The docket apparently contains prima facie evidence of criminal intent in the SAPS and centred on the corrupt activities of a rogue crime intel unit operating illegally in the Western Cape under disgraced Police General, Elvis Jula.

Kinnear also prominently mentioned the names of six suspects whose activities were supposed to be investigated at top level. Apparently, the docket was investigated by the Independent Police Investigative Directorate (IPID) who in turn sent it around July 2019 to the National Prosecuting Authority (NPA) in the Western Cape for a decision. Shortly after Kinnear's untimely death, it came out that the Kinnear docket had been “nollied” or closed (nolle prosequi) by the NPA.

Top-detective Charl Kinnear was gunned down by a lone shooter while sitting in his car outside his house less than ten months after police protection for him and his family was mysteriously withdrawn  

The Police had also still not revealed who gave the orders to cancel the authorized police protection for Kinnear and his family in November last year after Kinnear submitted all the evidence to proof that his life - and those of his family - were in danger.

About allegations that Kilian had pinged up to 10 000 numbers in six months, an expert in the field of tracking people for debt collection and vehicle repossession said it averages 55 pings per day - which is standard procedure as you sometimes have to ping the same numbers more than 10 times in order to track them.
"People who owe money always duck and dive and use more than one cellphone, so you have to keep trying until you can track them to the nearest cellphone tower. With a ping, you don't get an exact location - only a radius of approximately 800 metres."

There is also concern that Kilian is continuously being intimidated and cajoled into confessing or revealing information that he has no knowledge of. He has repeatedly offered to participate in any polygraph or lie detesting test, but to no avail.

Kilian was apparently one of many in the trade who bought their "ping bundles" with an accompanying unique login code from Bradley Goldblatt, who apparently also works for the SAPD.

Questions are now raised about how many people bought these ping bundles and tracking facilities from Bradley Goldblatt and whether they could use the same code to ping locations? Apparently Bradley had many clients in the Cape underworld.

What are the responsibilities and liability of these companies offering access to cellphone tracking facilities to prevent foul play?

While the investigation into Kinnear's murder seems to drag and focus entirely on an outsider from Springs with an insignificant one-man-business, not a word is mentioned about a police hunt for the young killer who was prominently captured on camera and those behind it.

No identikit of the killer's face was made in an attempt to get public assistance in identifying him and allegations that his body was seen in the morgue next to Kinnear's have not been refuted or confirmed.

HOEKOM is dié inwoners so kwaad vir Kilian as die beeldmateriaal duidelik wys dit is NIE hy wat Kinnear vermoor het nie? Hoekom plaas die gemeenskapskoerant Die Son nie die foto's van die skieter om die gemeenskap se gemoedere te laat bedaar sodat die ware moordenaar(s) vasgetrek kan word nie?

Kilian is glo boonop deur SAPD-lede aangemoedig om as Artikel 24-staatsgetuie op te tree in ruil vir "beskerming vir hom en sy gesin". Kilian het dit van die hand gewys omdat hy geen inligting het oor Kinnear se moord of die beplanning daarvan nie.

Eckardt Rösemann, het vroeër dokumente en bewyse by die hof ingedien waarin hy aanvoer dat sy kliënt nie moord gepleeg het, sameswering tot moord gepleeg het of die wet op telekommunikasiewetgewing oortree het nie, aangesien hy wettig geregistreer is by die betrokke beheerliggaam om ondersoek- en selfoonmoniteringswerk te doen.

Van die tergende vrae wat steeds nie beantwoord is nie, is:

*  WIE het die opdrag gegee om die polisiebeskerming aan Kinnear en sy gesin te staak?;

*  Hoekom het Militêre Intelligensie Kinnear se selfoon gemonitor?;

*  Hoe kan 'n jong man binne sekondes nadat hy 'n speurhoof helder oordag in Bishop Lavis doodgeskiet het, van die aardbol verdwyn en hoekom is sy bewegings ná die moord nie ook op beeldmateriaal vasgevang nie?

*  Wie is die persoon (Mohammed) wat Kinnear se selfoonnommer onder valse voorwendsels aan Kilian gegee het? Is Kilian juis as gerieflike sondebok geteiken omdat hy buite die Kaapse bendewêreld woon en 'n klein, eenman-besigheidjie in Springs bedryf wat geen risiko van uitkenning vir lede van die Kaapse onderwêreld inhou nie?

Publieke kommer neem sterk toe dat Kilian gerieflikheidshalwe die "sondebok" gemaak word om die aandag af te lei van die Polisie se gebrek aan vordering om die ware moordenaar op te spoor en dié wat daaragter sit.

"Terwyl Kilian in die media as die hoofverdagte uitgemaak word, kry die ware skuldiges kans om hul spore dood te vee. Hy hou ook geen bedreiging vir hulle in nie, want hulle weet hy weet niks van die moord nie en kan hulle dus nie verklap nie," het 'n ontstoke familievriend laat hoor.

Mense wil ook weet of die ooggetuies wat die skieter duidelik in die straat sien loop het onderweg na Kinnear se huis, al ondervra is.

"Hoe is dit moontlik dat niemand die jongman ken of herken het nie en dat hy ná die skietery spoorloos van die aardbol kon verdwyn?", is gevra.

Die enigste "klag" teen Kilian is blykbaar dat hy vanuit sy huis in Springs basiese selfoonmonitering vir kliënte landwyd gedoen het as deel van sy skuldinvorderingsbedryf en dat Kinnear se selfoonnommer een van dié is wat hy namens kliënte gemonitor het.

Intussen het dit aan die lig gekom dat die selfoonmonitering wat Kilian doen, basiese tegnologie behels wat maklik na hom teruggevoer kan word, terwyl die gesofistikeerde "GRABBER"-tegnologie deur enigeen in die Polisie of Regering gedoen kan word en nie nagespoor kan word nie. Verskeie mense kon dus Kinnear se selfoon gemonitor het sonder dat dit na hulle terugverwys kan word.

Kilian se tweede hofverskyning om aansoek te doen vir borgtog is vanoggend wéér uitgestel tot Woensdag 14 Oktober nadat 'n brigadier en kolonel van buite nou by die saak betrek is. Kilian bly in aanhouding tot dan om te hoor in watter hof sy borgaansoek aangehoor sal word.

Sy verskyning in die landdroshof in Bishop Lavis is weer gekenmerk deur 'n sterk polisie-teenwoordigheid en 'n ontstoke skare mense wat hom luidkeels toesnou. Dit is duidelik dat mense wraak soek vir die moord op Kinnear en Kilian is tot dusver die enigste beskuldigde op wie hulle hul woede en frustrasie kan fokus.

Kilian se regsverteenwoordiger, adv. Eckhard Röseman, het aangedring om dokumente ter stawing van sy kliënt se onskuld in te dien. Hy het onomwonde verklaar Kilian het NIE moord gepleeg nie; hy het NIE saamgesweer om moord te pleeg nie en het ook nie die wet op telekommunikasie oortree nie, aangesien hy wettig geregistreer is by die betrokke beheerliggaam wat hom in staat stel om opsporing en selfoonmonitering te doen.  

Uit betroubare bron is verneem as geen verdere bewyse teen Kilian gevind kan word en hy nie lig op die sluipmoord op Kinnear kan werp nie, sy borgaansoek nie teengestaan sal word nie.

Intussen is 'n aanlyn-petisie geloods teen Kilian se langdurige en "ongrondwetlike" aanhouding sonder borg en die kans om sy saak in 'n hof te stel.

Instead of focusing on these shocking revelations and finding the culprits who ordered the withdrawal of police protection for Kinnear and his family and nollied the docket, the police ambushed and raided the Springs home of 39-year old single dad Zane Kilian and arrested him for murder, conspiracy to commit murder and illegal interception of communication - just because he, as a father of a special needs son, was trying to make a living as a debt collector and doing tracking and investigations for various companies and people?

Zane, a former rugby player for the Falcons and Griquas, appeared under heavy police protection in the Bishop Lavis Magistrate’s Court last Friday and is held in custody in Bellville until his due court appearance and bail application on Monday.

Kilian had allegedly been tracking Kinnear’s cellphone for months, but according to reliable sources Kilian did cellphone tracking for various clients and didn't even know most of them or the people whose cellphones were tracked - including Kinnear.

In the light of the apparent high-level police involvement in Kinnear's assassination, it is feared that Kilian has been framed and used as a convenient "scapegoat" to protect Kinnear's rogue Police colleagues.

Concerned friends and family members now ask:
"Is Zane a convenient decoy because he is white, a former rugby player and the son of a former police colonel? Apart from his work, Zane has a full-time job as a single father taking care of his seven-year-old son who attends a school for children with special needs and requires constant supervision and care.

"Zayden suffers from cerebral palsy, Obsessive Compulsive Behaviour (OCB) and also needs medication for epilepsy. Furthermore, Zane hasn't set foot in Cape Town for years", an informed source said.

Zane is the youngest of four children of retired lt.col. Hein Kilian and the late Heila Kilian. Heila was tragically killed in an armed robbery in April 2018 during a visit to her sister and brother-in-law, Brenda and David Thomas, at their remote farmstead near Stilbaai. Zane's father, Hein (68), a respected former riot police commander in the Springs area, retired in 1992 already.

The random killing of Zane's beloved mother, also dubbed Lovey thanks to her loving personality, caused a global outcry of protest against farm murders in South Africa. The five accused have appeared in the regional district court in Mossel Bay earlier this year, but the court case is still ongoing.

The Kilian family - especially Zane who was extremely close to his mother - is still battling to accept her senseless killing and waiting for justice to be served in order to find closure. The bereaved Hein and all four children carried Heila's coffin into church at one of the biggest and most emotional memorial services in Springs. Close to a 1000 people paid their last respect to the well-loved Heila in the AGS Lofoord Church in Springs in 2018.

A family member mentioned that Heila was one of those people whom everybody loved. "She was beautiful inside and outside and would probably not have been able to deal with the horror that Zane has now been pulled into."

After his mother's death, Zane shaved his hair and had a heart and the word "MOM" tattooed on the side of his head as a tribute to his beloved mother.

While Zane is kept in custody awaiting his bail application, Zayden stays with his grandfather, Hein, and visits his mother over weekends.

"Zayden does not know what is going on and why his father does not phone him. Zane is his idol and anchor and the only person who can truly handle and comfort him. Zayden's physical and mental health is deteriorating fast and he is clutching out.

"We told him Zane is working in Cape Town, but he knows his father would never have left him without calling him regularly," an emotional Hein said.

Hein is bitter at the way his law-abiding son had been ambushed at night by 40 armed policemen apparently looking for a fancy office with sophisticated high-tech equipment and computers.

"I told the police officers I will take them to Zane's nearby home and even open the door for them as Zane was sleeping, but they nevertheless went ahead and broke down the back door . . . and in the end left with only Zane's two cellphones as he does not even HAVE computers or sophisticated equipment.

"All we want now is for Zane to be released and to get the opportunity to testify and tell his side of the story as soon as possible so that he can come home to Zayden."

4] It is also in the public domain that the six suspects mentioned by Colonel Kinnear in his Affidavit are:

Captain (f) Nadine Britz
Warrant Officer "Martin" Titus
Warrant Officer Riedwaan Titus and
Sergeant Billy Burrows

5] The docket was investigated by IPID and, in about July 2019, IPID sent the docket to the National Prosecuting Authority (NPA) in the Western Cape for a decision.

6] Now, I state for the record that this NPA office has already been captured and I have proof of this which prima facie evidence Police General Jeremy Vearey will provide to you (relating to a separate case involving two other disgraced Police Generals).

7] A few days after the assassination of Colonel Kinnear, I received a tip-off that the Kinnear docket had been “nollied” or closed (nolle prosequi) by the NPA.

8] During a program called #TheFix by Karima Brown (eNCA) on national tv on Sunday, 27 September 2020, she confirmed this and made public the recommendations of IPID which reads as follows:

“CONCLUSION:
There was an obvious collusion between Captain Alfred Barker, Captain Nadine Brits, Warrant Officer Riedewaan Titus and Warrant Officer Martin Titus to open cases that had been closed to intimidate and harass witnesses to make false statements against members whom they have a grudge against. It is also confirmed by the Divisional Commissioner of Crime Intelligence that these members are a rogue unit trying to derail the investigation against certain underworld high flyers in the Western Cape. The suspects also defamed the character of members by spreading rumours that they are corrupt policemen.

IPID RECOMMENDATION:
Based on the above information contained in the case docket, the IPID recommends that Captain Alfred Barker, Captain Nadine Brits, Warrant Officer Riedewaan Titus and Warrant Officer Martin Titus be prosecuted for Defeating and/or Obstructing the Course of Justice, Intimidation and Crimen Injuria”. End

9] Minister Lamola, I put it to you that for all of his working life in the Police Service (three decades), Colonel Charl Kinnear was a dedicated police officer who stood against corruption and, there was a very particular reason why he opened this docket – he was taking a stand against the deep rot of corruption in the Police Service.

10] Colonel Kinnear would never have accepted this captured decision of the NPA and would’ve taken this corrupt decision on review.

11] To put it to you bluntly, Minister Lamola, there is simply no basis in law for the NPA to have made this decision in view of the prima facie evidence in the docket.

12] That’s not all Minister. It was also brought to my attention that there were eight other police dockets (attached to the IPID docket) that were also “nollied” by the captured NPA; one of which was the Spur shooting docket that Colonel Kinnear mentioned specifically in his 59 page Affidavit. Kinnear highlighted how certain dirty cops had attempted to interfere with the police investigation into a 2018 shooting incident at a Spur restaurant involving another alleged underworld figure.

13] The information that I received, Minister, indicates that all these eight dockets have already been returned to their respective police stations where they were originally opened and - have been archived as closed.

14] Minister Lamola, Government has gone on record as having encouraged all our citizens to act against all forms of corruption wherever it manifests itself. I have been doing this for more than two decades but have nothing to show for it.

15] I don’t really know why the President preaches from the rooftop about what the Government is doing in the fight against corruption when the reality on the ground is, very obviously, quite different.

16] Minister Lamola, it is now up to you to help me draw that line in the sand.

17] I instruct you, as I hereby do, to reopen the IPID docket as well as the eight other SAPS dockets and to commence the process of crushing all dissent in our collective fight against corruption. If you cannot do this, Minister, then it simply means that you are also captured and I will have to resort to another plan to make myself heard.

18] Kindly also speak to your colleague, Minister Bheki Cele about immediately suspending the six members of the rogue crime intel unit which matter I referred to the office of the National Police Commissioner on 1 October 2019 – there has been no action to date except that the complainant, Colonel Charl Kinnear has now been assassinated.

Voorts is daar onomstootlike bewyse dat Kilian in daardie stadium in 'n apteek in Springs was om medisyne vir sy sewejarige seuntjie met spesiale behoeftes, Zayden, te koop en jare laas in die Kaap was.

Terwyl Zane Kilian se familie en vriende toenemend vrees vir sy veiligheid en hy geen kontak met enigeen mag hê nie - nie eens met Zayden wat grootliks van hom as enkelouer afhanklik is nie - is 'n gebedsgroep in die Paarl vir Zane gestig. Die groep het onderneem om Donderdag heeldag te vas en vir Zane se veiligheid te bid.
Zayne se familie vrees hy word nou as sondebok aangehou en verdag gemaak om die korrupte polisielede te beskerm wie se bedrywighede Kinnear al jare lank ondersoek en waarin hy op die punt was om 'n deurbraak te maak.

In die weke voor sy dood het hy in Springs aan die Oos-Rand gewerk waar hy dossiere, wat verband hou met die senior polisielede se betrokkenheid by die smokkelnetwerk, ondersoek het.

Kinnear het ook Nafiz Modack, een van die vermeende rolspelers in Kaapstad se onderwêreld, ondersoek rakende sy beweerde betrokkenheid by die uitreik van onwettige vuurwapenlisensies by polisiekantore in Gauteng.

Netwerk24 het vroeër berig Modack en twintig ander mense, onder wie vuurwapenhandelaars en polisielede, is reeds in Junie vanjaar in verband daarmee in hegtenis geneem en het op 17 Junie in die landdroshof in Kempton Park verskyn.
Hulle staan tereg op aanklagte van bedrog en regsverydeling en aanklagte wat verband hou met oortredings van die Wet op Vuurwapenbeheer.

Terwyl Kilian nou al langer as twee weke aangehou word op aanklagte van moord, sameswering om moord te pleeg en die onwettige onderskepping van kommunikasie, is die werklike "skieter" en die mense wat die opdrag vir die sluipmoord gegee het, steeds soek . . .

Die saak teen Kilian is tot 9 Oktober uitgestel om 'n ander "veiliger" hof vir sy borgtogaansoek te kry. Sy aansoek gaan na 'n streekhof oorgeplaas word wat eers Vrydag bekend gemaak sal word.

Kilian se regsverteenwoordiger, adv. Eckhardt Roseman, het aangevoer as die speurders wat Kilian so oorhaastig in hegtenis geneem het nie 'n lasbrief gehad het om toegang tot sy selfoonrekords te kry nie, is alle bewysstukke rakende sy inhegtenisneming bowendien nie toelaatbaar in die hof nie.

Staatsaanklaer Greg Wolmarans het hierop geantwoord dat 'n landdroshof nie die plek is om te besluit oor toelaatbaarheid van inligting of nie, en dat hulle 'n aansoek moet indien as hulle toegang soek tot die staat se inligting - wat die staat sal bestudeer en oorweeg.

Die flou en verdagte "omstandigheidsgetuienis" teen Kilian wat volgens kennisse en ingeligte bronne nie eens geweet het wie Kinnear of die meeste mense is wie se foonnommers hy bloot moes naspoor nie, berus blykbaar meesal op "wenke" van berugte rolspelers in die Kaapse onderwêreld soos Jerome "Donkie" Booysen wie se bedrywighede juis deur Kinnear ondersoek is.

Last week an Israeli-made cellphone signal grabber, or IMSI-catcher, made headlines after amaBhungane published an investigation into Willie Lotter and Joseph Pooe, who were arrested by the Hawks for the alleged illegal possession of an IMSI-catcher.

The implications of this device are enormous. In the wrong hands, it can be used to eliminate political rivals, curb a free press by targeting investigative journalists, and in the case of Lotter and Pooe, allegedly help bug members of the Airports Company of South Africa’s bid adjudication committee which makes decision on contracts worth hundreds of millions of rand, according to The Star.

What is even more frightening is that in recent years, IMSI-catcher technology – which was previously only within the grasp of governments – is now accessible to hackers and researchers who have been able to successfully build their own grabbing devices.

Most recently, a research team from Helsinki and Berlin were able to build an IMSI-catcher device that works on newer 4G/LTE networks (more advanced even than the Engage PI2’s capabilities) and is able to precisely pinpoint a cellphone’s location based on the signals it transmits when using apps such as WhatsApp and Facebook, with no knowledge from the owner of the phone that tracking is taking place.

But what exactly is the device, and what can it do?

IMSI-catchers, or grabbers, have been around since 1996, with German and Israeli companies pioneering the early technologies. The first publicly known IMSI-catcher was made by German electronics manufacturer Rohde & Schwarz. Subsequent manufacturers have marketed the devices as “anti-terror equipment” with many law enforcement and intelligence agencies across the world making use of the devices – most notably and controversially perhaps is the use of the Stingray phone tracker by US police.

Thanks to our friends from the amaBhungane Centre for Investigative Journalism, Daily Maverick is in possession of a user manual for the Verint Engage GI2, a grabber which functions very similarly to the Engage PI2 device confiscated from Lotter and Pooe by the Hawks. (See main photo)

Simply, the device works as a cellphone tapper, tracker and locator. It does this by masquerading as a cellphone tower and forcing nearby handsets to connect to it. Once a handset has connected, the device can identify the target handset’s international mobile subscriber identity (IMSI) number and use the number to track the phone’s movements, pinpoint its location, intercept its calls, or eavesdrop on conversations occurring around the phone.

This is all done covertly, and the data collected is analysed in real time by the device. Some grabbers, such the Engage PI2 and GI2, have sim cards that allow them to reroute the captured calls to third parties.

The device comes in either a trolley case or attache-style case, and is controlled by a laptop computer. Most often the device is operated from a vehicle to allow it to get closer to target handsets – in the case of Lotter and Pooe, the unit was installed in a Mercedes Viano.

The device falls under a special category of equipment in South Africa designated for the interests of national security and can therefore only be bought with presidential authority, and is said to be worth more than R25-million.

The Engage GI2 has a number of features:

GSM Call Routing: The unit allows the user to route a target phone’s call through the device and into the real GSM network, effectively acting as an invisible “man in the middle” who is able to eavesdrop on the target’s conversation.

Cloning: The device allows the user to clone a target’s phone and make/receive calls and text messages that will appear as if they are coming from the target’s number.

SMS: The device allows the user to simulate a cell network, forcing phones over a large area to connect to the device. Once connected, the device is able to capture all text messages sent over that period.

Silent call: This function initiates a call to the target phone, turning the phone’s transmitter into a location tracking beacon. While a silent call is active, the target phone is disconnected from the real network, shifted to an unused channel and cannot make or receive any calls. While a silent call is active, the phone appears to be in standby mode and can be used as a tracking device to determine the target’s movements.

Eavesdropper: The device allows the user to listen and record audio from the target phone’s handset. As described in the manual, “This functionality turns a target’s own mobile phone against the target by turning it into a ‘bug’. The voice from the target’s mobile is being recorded from the time the mobile starts ringing. The voice will continue to be recorded after the target hangs up.”

The device enables its operator to identify potential and known targets and build an intelligence picture in an area of operation. It also can help identify a potential target – it records all calls and SMSes and enables operators to listen to any call that appear relevant. The operator can choose to focus the operation on the targets for ongoing monitoring.

It can build an intelligence picture of a known target by intercepting target’s traffic according to predefined cellular identifiers, key words and voiceprints.

Grabber technology

“The real scandal here is not around this particular grabber,” says Murray Hunter, spokesperson for the Right2Know Campaign, “but rather that the state has its own such devices. We don’t know how many, we don’t know how they’re used, but what we do know is that the use of these devices is almost certainly illegal in terms of RICA.

“A judge has to sign a warrant before the state can intercept someone’s phone information,” he continues, “and a grabber is a mass surveillance device so when you turn it on you’re immediately intercepting 10,000 signals and you’re tapping the phone of everyone in that radius.”

In September last year, Right2Know submitted a Promotion of Access to Information Act (PAIA) request to SAPS and SSA for evidence that they were given warrants to use these surveillance services, but all PAIA requests were denied.

All’s not lost, however. There are some steps that can be taken to prevent the government (or anyone else) from snooping on you with one of these devices. Various smartphone apps are now available which can minimise the risk of your signals being intercepted. One is the Android IMSI-Catcher Detector which alerts you if an IMSI-catcher attempts to connect to your phone and then blocks the signal. Another is SnoopSnitch which operates in a similar way.

Some may not be concerned about this device and its capabilities because they may think they have “nothing to hide”, but that fundamentally misses the point. These capabilities in the wrong hands fundamentally violate our constitutional right to privacy of communications, and as Edward Snowden said, “Arguing that you don’t care about the right to privacy because you have nothing to hide is no different than saying you don’t care about free speech because you have nothing to say.”

“The next step for the public is not just about seeing the prosecution of a few shady characters,” Murray Hunter says, “but really pushing government to come clean on how it uses surveillance and how it created the situation in which these men can be caught with an imported grabber in the boot of their car.” DM
